Common Documentation Gaps That Weaken a Bank's SARFAESI Case

By the time a SARFAESI enforcement is challenged, the documentation that will decide the outcome was usually created long before, at loan sanction, at security creation, in routine account correspondence. The following gaps recur often enough to be worth checking proactively, rather than discovering them mid-litigation.
Incomplete or Unregistered Security Documents
Mortgages, hypothecations, or charges that were not properly executed, stamped, or registered where required create an immediate vulnerability: the secured creditor's very right to invoke SARFAESI depends on a valid security interest existing in the first place.
Mismatched Property Descriptions
Where the property description in the loan and security documents does not precisely match land records, survey numbers, or later notices, the discrepancy becomes an opening for a borrower to argue the notice does not correctly identify the secured asset.
Missing Records of Account Statements Shared With the Borrower
Where a demand figure is disputed, the bank's ability to produce a clear, contemporaneous account statement trail showing how the outstanding amount was arrived at is often what settles the dispute in the bank's favour.
Poorly Preserved Communication Records
Proof of notice delivery, responses to a borrower's representation, and any settlement correspondence should be retained systematically. Gaps here weaken the bank's position even where the underlying enforcement action was substantively correct.
Guarantee Documents Not Kept Current
Where loan terms are later modified, restructured, or extended, guarantee documents should be updated or reaffirmed accordingly. A guarantee that does not reflect the current terms of the facility is a common point of successful challenge by a guarantor.
The Fix Is Preventive
A periodic documentation audit, before an account ever becomes non-performing, closes most of these gaps at negligible cost compared to discovering them after a Section 17 challenge is already underway.
