Possession & Auction Assistance

Legal support for taking possession of secured assets and conducting a compliant, defensible e-auction sale.

Overview

Taking possession is often where SARFAESI enforcement meets real-world resistance. Where a borrower does not hand over possession voluntarily, an application under Section 14 before the District Magistrate or Chief Metropolitan Magistrate is required. We handle these applications, coordinate with court receivers and local authorities, and ensure the subsequent e-auction sale is conducted strictly in line with the Security Interest (Enforcement) Rules so the sale cannot later be challenged.

What This Covers

  • Section 14 applications for assistance from the District Magistrate/CMM
  • Coordination with court-appointed receivers and local police for possession
  • Valuation, reserve price, and e-auction notice compliance
  • Sale certificate issuance and post-sale confirmation
  • Defending completed sales against belated borrower challenges
